Some people might expect a divorce book written by a judge to stress the importance of the judicial system in helping couples reach a just outcome in their divorce. If this is you, then you might be surprised at the advice offered by Judge Robert Duncan in this book.
Judge Duncan tells it like it is. He doesn’t aggrandize himself or the family law system to which he devoted most of his judicial career. For example, on dealing with divorce courts he states, he “saw over and over again that the system stinks.” Surprising stuff coming from a Judge!

As a brand new fan of this site I was pleased to see a review of Rod Duncan’s book. Rod and I were in a “study group” of family lawyers from around the country who practiced in unusual ways. It was organized by Ed Sherman who wrote “How To Do Your Own Divorce in California” during his first year out of law school. It’s published by the Nolo Press; Ed hasn’t had to do much work ever since. [I prescribed the book to all clients, not because they are going to do their own divorce, but because it take the mystery out of the legal process.
I'm glad Rod finally wrote a book to memorialize his experience on the family court bench. I hope you'll do the next blog on "Why does the system stink." [It's likely to be a long one.]
