Divorce Posts

SmallerBoyMoneyPhoto Death and Taxes Blog has a good post on the importance of thinking of all possibilities when drafting your Will.

When drafting your Marital Settlement Agreement you and your lawyer should take care to consider all possibilities since, if you don't do so, the agreement you and your spouse reach could end up being meaningless.

Conclusion: Think everything through.

Iowa Divorce Lawyer has a blog post on a study that shows that brilliant scientist’s achievements waned after they got married:

Within five years of making their nuptial vows, nearly a quarter of married scientists had made their last significant contribution to history’s hall of fame. “Scientists rather quickly desist (from their careers) after their marriage, while unmarried scientists continue to make great scientific contributions later in their lives,” says Dr. Kanazawa.

If you’re an average married man, though, no need to despair. Studies show that married men earn 11% more than their unmarried counterparts.

What I really want to know: How does divorce affect genius?

EggShellDuck_opt Few areas of the law are evolving as rapidly as the area dealing with paternity, sperm donors and artificial insemination. The law tends to be static and has trouble catching up to scientific advances. As of now, many cases are dealt on a case-by-case basis.

The Pennsylvania Family Lawyer writes on a recent case decided in Pennsylvania:

The court looked at the spectrum of cases regarding child support obligations where the parties are not married. On one side, they affirmed that children born from a sexual relationship are always entitled to child support, and neither parent can give up the child’s right before or after birth. On the other side, anonymous sperm donors are absolved of child support obligations, because to do otherwise would mean that such arrangements would not occur.

Note: This decision does not apply to Chicago, Illinois. However, it should give you an idea of how courts generally decide these new cases where no specific statute applies to the facts of the case.
